Direct Lettings – Brighton – Unfair Charges Part 2

A while ago I posted about Direct Lettings’s  ( address. 20 Western Road, Hove, East Sussex, BN3 1AE.  phone. 01273 324535.) unfair administrative charges.  Direct are a particularly money grabbing estate agents down on the south coast in Brighton. The fee I got stung for was a £45 fee + vat for accidentally paying them too much rent! They charged this as a fee to pay me back my own money.This is of course and illegal charge as it was never agreed in the initial contact. As with Bank charges it doesn’t represent that actual loss they have incurred so it is challengeable The Unfair Terms in Consumer Contracts Regulations 1999. finally the law states that if you pay someone accidentally they have to repay the money. If they don’t then it’s the equivalent of theft, I believe the legal term “being obtaining money through dishonest means” although I am no Lawyer.Anyway I made a complaint to the National Association of Estate Agents who found direct in Breach of their Rules of Conduct. Direct will now be receiving an official warning letter from them and if they ever get up to mischief again they will be in trouble. A very curt and annoyed manager agreed to give me back the money under the threat of legal action.Of course I am now surrounded by a warm and smug feeling of triumph which is most satisfactory. Now all I have to do is decide whether to rub salt into the wound by reporting them to trading standard. What do you think reader?
